Limitations on Yard Sales (A) Yard Sales shall be conducted only on property owned by or rented on a minimum of a month-to-month basis to the person conducting the sale. (B) No person may conduct more than two yard sales within any one calendar year. (C) The length of any one yard sale shall not exceed three consecutive days, or portions thereof.
Exceptions The provisions of this chapter shall not apply to any of the following sales or persons: - Persons selling goods pursuant to an order or process of a court of competent jurisdiction or those items repossessed and sold pursuant to the Uniform Commercial Code or a purchase money security agreement or to extinguish a statutory lien
- Any person selling or advertising for sale an item or items of personal property which are specifically named in the advertisement and which separate items do not exceed four in number.
- Sales conducted by recognized religious, charitable, educational, civic, or fraternal corporations or associations
- Bake sales, hot dog sales, candy sales, farmer’s produce sales or other similar foods sales are specifically not included within the definitions of a yard sales.
Penalty Any person violating any of the provisions of this chapter shall, upon conviction, be fined not less than ten dollars ($10.00) nor more than one hundred ($100.00) for each violation. Each day a yard sale is conducted in violation of this chapter shall constitute a separate offense. |
